Judges, although not policymakers, play a crucial role in implementing public policy. As street-level bureaucrats, judges hold the authority and discretion to make policies executable, acting as a critical interface between law and lived experience. Human decision-making, however, is not immune to biases—even among judges. These biases arise from heuristics, mental shortcuts that facilitate decision-making but can lead to systematic errors. Nonetheless, citizens are entitled to a fair and impartial tribunal, a cornerstone of democratic governance enshrined in the Universal Declaration of Human Rights. This study investigates whether Brazilian judges, as a bureaucratic elite, are less susceptible to cognitive biases than non-judges and whether institutional mechanisms can mitigate those biases. Integrating insights from political science and behavioral analysis, it examines how elite profiles and institutional contexts shape decision-making. Specifically, it tests whether mechanisms such as accountability and reason-giving function as debiasing devices in judicial reasoning. To do so, the research employs a vignette-based survey experiment with Brazilian judges, public servants, law students, and lay citizens. By comparing their responses across controlled public policy scenarios, the study assesses (i) susceptibility to specific cognitive biases, (ii) the moderating effect of institutional mechanisms, and (iii) the extent to which professional formation and elite status reduce bias expression. The findings aim to contribute to the growing literature on judicial behavior and cognitive bias by situating it within Brazil’s institutional and legal context. They also seek to advance our understanding of how bureaucratic elites internalize accountability norms and whether institutional design can foster more rational and impartial decision-making.
