The frequent accidents involving dams, most of them refers to small embankment dams, raise questions about the effectiveness of the National Dam Safety Policy (PNSB) established by Law n° 12,334/2010. After a major accident, such as those that occurred at the mining tailings dams in Mariana/MG (11/05/2015) and Brumadinho/MG (25/01/2019), there is a political mobilization to make the law more effective, however in Brazil about 60% of more than 20,000 dams do not even have the minimum information to verify if they meet the law requirements. The law determines that the dam’s owners are legally responsible for safety and must compensate the damages caused by their failure, regardless of the existence of fault. Meanwhile, the dam safety supervision rests to the institution that granted the permission, license or regulates the exercise of the activity carried out by the entrepreneur. Among more than 13,000 dam owners registered, the one with the largest number of dams under its responsibility is the National Department of Works Against Drought (DNOCS). At the list of more than 220 dams, more than 60 were simultaneously classified at the category of high risk category and potential hazard, which includes Jucazinho. Jucazinho is located ate Pernambuco state and has an important regional role for water supplying and flood risk management in the Capibaribe River basin, including to reduce impacts in the Metropolitan Region of Recife/PE. DNOCS have being sued by Federal Prosecution Office and by the Federal Court of Accounts due to problems with contractors hired to repair the dam and to spillway rehabilitation. The first Emergency Action Plan (PAE) developed by DNOCS was to Jucazinho in 2017, which involves 13 institutions. These elements demonstrate the complexity of implementing the PNSB in a specific relevant case. Questions arise whether the apparent low effectiveness in complying with the law's requirements is due, for example, to the fact that it was conceived without the provision of adequate means for compliance by the owners, especially the public companies whose carried out these major works even before the advent the law and do not have enough revenue in their budgets to maintain them. Another relevant issue that may contribute to identify alternatives to improve the dam safety policy is to understand the point of view of each actor involved in the process, such as dams’ owners, supervisory agencies, city halls, civil defenses and population at risk areas, which may pointed out what they see as problems and possible solutions. Conducting a survey that gather these elements to analysis and applying some concepts typical of the political, social and administrative sciences should contribute to think on new guidelines to enhance the dam safety public policy.
