SUMMARY:

The central theme of the thesis is the inter-federative governance established in the Metropolis Statute (Federal Law No. 13.089/2015), as a necessary condition to ensure the integrated urban development of the subdivision, use and occupation of metropolitan urban land, adopting it as a case study the Metropolitan Region of Recife. The thesis is developed from three axes, deepening the legal framework and the theoretical framework on the themes involved: (i) The recent metropolization process under the aegis of financial capital and the possible conflicts generated between municipalities; (ii) The public function of common interest among municipalities, aiming to clarify when subdivision, land use and occupation fall into this category; and (iii) Metropolitan or interfederative governance and the application of the legal instruments provided for in art. 9 of the Metropolis Statute. Such instruments are: integrated urban development plan; inter-federative sectoral plans; public funds; inter-federative consortium urban operations; zones for shared application of the urbanistic instruments foreseen in the City Statute, Federal Law nº 10,257/2001 (BRASIL, 2001); public consortia; cooperation agreements; inter-federative public-private partnerships; management contracts; and compensation for environmental services or other services provided by the Municipality to the urban territorial unit, as provided for in the Metropolis Statute (Art. 7, VII). As a result, the thesis presents possibilities of interfederative governance in the metropolitan management of conflicts established between municipalities in the Metropolitan Region of Recife, adopted as an empirical object of analysis of concrete problems, based on the aforementioned instruments provided for in art. 9 of the Metropolis Statute.
