SUMMARY:

The growing technological development, the digitization of the economy and the opening of markets resulting from the fourth industrial revolution led to a series of changes in the business legal environment and technological innovation, which culminated in the modernization of the Brazilian regulatory set of public procurement, especially the involving innovation contracting by the public sector. This work aims to present a comparative analysis between the Brazilian legislative framework and the European model of public procurement of innovation. In order to do so, the Brazilian legislative trajectory will be covered over the last two decades, from the enactment of the Innovation Law, in 2004, through the Legal Framework for ST&I, in 2016, to the new Law on Tenders and Contracts and the Legal Framework for Startups, 2021, and, at the same time, present the evolution of European legislation for public innovation contracts, from the edition of Directive 18/2004 to the advent of Directive 24/2014. The study intends to carry out a critical analysis of the legislation, highlighting the points of coalition and dissonance existing between the legal texts, based on the innovative public procurement system adopted by the European Union since the beginning of the 21st century. The choice of the European model is justified for its international reference, adopted by major institutions of world development, such as the IDB (Inter-American Development Bank), especially in Latin America. In the end, it is intended to identify the existing agreements and divergences between the laws studied, and to evaluate the themes that can still be incorporated into Brazilian regulations, with the premise of promoting a greater and more comprehensive applicability to the new national legislative set.
