SUMMARY:

The objective of this work was to analyze the effectiveness of practices for protecting the intellectual property of computer programs in software development companies (startups) in Porto Digital. This locus was sought, taking into account the nature of the companies belonging to the largest urban and open technological park in Brazil, and also, due to the increased interest of these companies, in the protection of these computer programs, due to their importance in the context of generating economic and technological values. From a theoretical point of view, the work was developed based on the concepts of intellectual property, in particular the rights of the author, as a software developer, through its registration, as well as, from the perspective of these startups, regarding protection models. From a method point of view and aiming to understand protection models and their effectiveness in the daily lives of these companies, the study carried out an analysis of Brazilian legislation, international agreements and statistics related to software registrations. The study adopted a methodological approach that combines qualitative and quantitative approaches, being descriptive and exploratory in nature. The study of multiple cases was used as a means to achieve the proposed objectives. The methodological design included the delimitation of the research environment in technology companies in Recife, especially in Porto Digital. A deductive methodology was used, including bibliographic, documentary and field research. The field research involved semi-structured interviews and questionnaires aimed at owners and/or administrators of software development companies in the region. The results pointed to a lack of emphasis on software protection, reflected in the scarce number of requests for registration of computer programs. Additionally, they revealed that companies that adopt some degree of protection enjoy a significant competitive advantage over others. Based on this approach, effective models were analyzed and synthesized. As a final outcome, this academic study culminated in the elaboration of a manual of good practices to protect the intellectual property of computer programs, aimed at software development companies, offering practical guidance to address this complex issue in the Brazilian scenario.
